I. Basic Provisions

Personal data means any information relating to an identified or identifiable natural person; an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, identification number, location data, online identifier, or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural, or social identity of that natural person.
The Controller has not appointed a Data Protection Officer.
II. Sources and Categories of Processed Personal Data
The Controller processes personal data that you have provided to him or personal data obtained by the Controller on the basis of fulfilling your order:

The Controller processes your identification and contact details.
III. Legal Basis and Purpose of Personal Data Processing
The legal grounds for processing personal data are:

the performance of a contract between you and the Controller pursuant to Article 6(1)(b) GDPR,

compliance with the legal obligation of the Controller pursuant to Article 6(1)(c) GDPR,
-
the legitimate interest of the Controller in providing direct marketing (in particular for sending commercial communications and newsletters) pursuant to Article 6(1)(f) GDPR,
-
your consent to the processing of personal data for the purposes of direct marketing (in particular for sending commercial communications and newsletters) pursuant to Article 6(1)(a) GDPR in conjunction with § 7(2) of Act No. 480/2004 Coll., on Certain Information Society Services, in cases where no order for goods or services has been placed.
The purposes of processing personal data are:

processing your order and exercising the rights and obligations arising from the contractual relationship between you and the Controller; when placing an order, personal data necessary for successful processing (name, address, contact) are required—providing personal data is a necessary requirement for concluding and performing the contract; without providing personal data, the contract cannot be concluded or fulfilled by the Controller,

fulfilling legal obligations towards state authorities,
-
sending commercial communications and carrying out other marketing activities.
The Controller does not engage in automated individual decision-making within the meaning of Article 22 GDPR. You have given your explicit consent to such processing.
IV. Data Retention Period
The Controller stores personal data:

for the period necessary to exercise the rights and obligations arising from the contractual relationship between you and the Controller and to assert claims from such contractual relationships (for a period of 15 years after the termination of the contractual relationship).
After the retention period expires, the Controller deletes the personal data.
V. Recipients of Personal Data (Subcontractors of the Controller)
Recipients of personal data include persons:

involved in the delivery of goods/services or payment processing based on a contract,

providing services related to the operation of the online store (Shoptet) and other services associated with e-shop operation,
-
providing marketing services.
The Controller has no intention to transfer personal data to a third country (outside the EU) or to an international organization.
VI. Processors of Personal Data
The processing of personal data is carried out by the Controller; however, personal data may also be processed for the Controller by the following processors:

the service provider Mailchimp,
-
and possibly other providers of processing software services and applications not currently used by the Controller.
VII. Your Rights
Under the conditions set out in the GDPR, you have the right to:

access your personal data pursuant to Article 15 GDPR,

rectification of personal data pursuant to Article 16 GDPR or restriction of processing pursuant to Article 18 GDPR,

erasure of personal data pursuant to Article 17 GDPR,

object to processing pursuant to Article 21 GDPR,

data portability pursuant to Article 20 GDPR, and
-
withdraw consent to processing in writing or electronically to the address or e-mail of the Controller specified in Article III of these terms.
You also have the right to lodge a complaint with the Office for Personal Data Protection if you believe that your right to personal data protection has been violated, or to seek judicial remedy.
VIII. Conditions for Securing Personal Data
The Controller declares that he has taken all appropriate technical and organizational measures to secure personal data.
The Controller has taken technical measures to secure data storage and storage of personal data in paper form.
The Controller declares that personal data are accessible only to persons authorized by him.
IX. Final Provisions
By submitting an order via the online order form, you confirm that you are familiar with the terms of personal data protection and that you accept them in full.
You express your consent to these terms by ticking the consent box in the online form. By doing so, you confirm that you are familiar with the terms of personal data protection and that you accept them in full.
The Controller is entitled to amend these terms. The new version of the personal data protection terms will be published on the Controller’s website and, at the same time, sent to your e-mail address provided to the Controller.
These terms are effective as of May 25, 2018.
